This is the Wing of the museum that contains the last constitution of Emeraldia, along with the Declaration of Emeraldia. The Original constitution, that was approved in November of 2006, was lost in the attacks that destroyed Emeraldia.

Constitution of the Irish Republic of Emeraldia
Written in Convention, March 20, 2007

In the Name of the Most Holy Trinity, from Whom is all authority and to Whom, as our final end, all actions both of individuals and States must be referred,
We, the people of Emeraldia,
Humbly acknowledging all our obligations to our Divine Lord, Jesus Christ,
Who has given all people the freedom of life,
And seeking to promote the common good, with due observance of Prudence, Justice and Charity, so that the dignity and freedom of the individual may be assured, true social order attained, the unity of our country guaranteed, and concord established with other nations,
Do hereby adopt, enact, and give to ourselves this Constitution.

Article 1: The Executive
Section 100: Definition
100.1: The Executive of the Irish Republic of Emeraldia shall be the elected President of the Republic.
100.2: The President may be any citizen who has been a citizen for at least one month.

Section 101: Term
101.1: The President shall serve a three month term
101.2: A person elected President shall serve no more than 4 terms in a row.
a. A person who has served as President for 4 terms may seek reelection if he or she wishes is to do so after someone else has held the office for at least one term.
b. A person who has been elected President may serve as many non-consecutive terms as he or she wishes

Section 102: Duties and Powers
102.1: The President shall be required to open each session of the Seanad.
102.2: The President shall appoint a cabinet, whose members will head all of the national departments
102.3: The President must, along with the Seanad, approve all treaties with foreign nations.
102.4: The President may pardon any citizen who has committed, or been convicted of committing a crime.
102.5: The President shall have the power to act for the good of the Republic, by establishing any agency or department, or any other sort of action that he or she deem necessary, so long as it is not implicitly against the law.
a. The Seanad may review the President’s actions at any time, and may choose to expressly give the President the power he already exercised, or may expressly forbid the President from doing whatever it was that he or she did.
b. Even if the Seanad forbids a power to the President using this clause, the President cannot be punished for his or her initial action.

Section 103: The Cabinet
103.1 The President shall appoint citizens to head the following departments which shall comprise the Presidential Cabinet:
103.2: The Department of Foreign Affairs- Shall be in charge of overseeing all relations with foreign countries
103.3: The Department of Defense- Shall be charged with the security and defense of the Republic, and shall oversee all military forces
103.4: The Department of the Treasury- Shall be in charge of minting money, running the National Bank of Emeraldia, and regulating the economy
103.5: The Department of the Interior- Shall be in charge of creating and maintaining the national maps, overseeing transportation, taking the national census, and running/regulating provincial governments
103.6: The Department of Irish Culture- Shall be in charge of protecting and promoting the Republic’s culture, and shall be in charge of Education
103.7: The Department of Communication- Shall be in charge of overseeing, running, and or regulating all forms of communication in the Republic, as well as maintaining the national Blog
103.8: The Department of Science- Shall be in charge of all research and technological development in the Republic
103.9: The Department of Religion- Shall be in charge of all Government-Religious relations
103.10: The President shall also appoint one person to serve as the Director of the Emeraldian Security Protectorate, a department which shall oversee and run all security bureaus/agencies within the Republic.
103.11: All Presidential appointments must be approved by majority consent in the Seanad.
103.12: Any member of the cabinet, and or the Director of the ESP may be removed from office by way of a national hearing, presided over by the Chief Justice, who shall not vote unless there is a tie.
a. removal proceedings must allow for at least 48 hours of debate/ argument time before a vote is called
b. a person may only be removed from office if that person has committed treason, terrorism, papalism, or has committed other serious crimes against the Republic
103.13: If a department head has been removed from office, and he or she has not appointed a successor, the vacancy will be filled by Presidential appointment, and confirmed by the Seanad

Section 104: Removal and Succession
104.1: The President may be removed from office by way of a national hearing, presided by the Chief Justice, who shall not vote, unless there is a tie, or by way of a Seanad Removal Hearing, which would require a full vote of the Seanad and a 3/4 vote of the citizens for removal.
a. removal proceeding must allow for at least 48 ours of debate/ argument time before vote is called
b. The President may only be removed from office if he or she has committed treason, terrorism, papalism, or has committed other serious crimes against the Republic
104.2: In the case of a Presidential vacancy, either by forcible removal, resignation, or by other incapacity, the line of succession shall be:
a. Vice President
b. The Cabinet, in order listed in Article 1, Section 103 of this constitution
c. The Director of the ESP
d. Chief Justice of the Supreme Court
104.3. In the case of a Presidential vacancy, the successor shall remain as temporary President until the next regularly scheduled Presidential election.

Article 2: The Legislative
Section 200: Definition
200.1: the Legislature of the Republic shall consist of the Seanad of Emeraldia
200.2: the Seanad shall consist of elected 5 representatives
200.3: a representative in the Seanad may be any citizen who has been a citizen for at least 1 month.
200.4: The Seanad shall be lead by the Vice President, who will be elected from among members of the Seanad by the Seanad, and who shall only vote in the instance of a tie.

Section 201: Term
201.1: A representative shall be elected to a term of three months.
201.2: There is no term limit on a representative.
Section 202: Powers
202.1: The Seanad shall have the following powers:
202.2: The power to order the minting of money

202.3: The power to create any and all military forces within the Republic
202.4: The power to approve all treaties between the IRE and all other nations and international organizations
202.5: The power to declare war.
202.6: The power to pass laws to see to the well being of the citizens
202.7: The power to pass laws to preserve the peace within the Republic.
202.8: The power to raise money for the government of the Republic.
202.9 For laws or orders or any other item passed by the Seanad to go into effect, the President must sign/ approve the item for it to become official. It the President veto’s an item passed by the Seanad, the Seanad may override the President’s veto with a 2/3 majority vote.

Section 203: Removal and Vacancy
203.1: A representative may be removed from office by way of a national hearing, presided by the Chief Justice, who shall not vote, unless there is a tie.
a. removal proceeding must allow for at least 48 ours of debate/ argument time before vote is called
b. A representative may only be removed from office if he or she has committed treason, terrorism, papalism, or has committed other serious crimes against the Republic
203.2: In the case of a representative vacancy, whether by removal or other vacancy, a special election will immediately to fill the vacancy. It the Vice Presidency is vacated, then after the special election the Seanad will vote on a new Vice President.

Article 3: The Judiciary
Section 300: Definition
300.1: The Judiciary of the Republic shall consist of the Supreme Court of Emeraldia, and any lower courts that are established by the Seanad.
300.2: The Supreme Court will consist of a minimum of 1 justice, with a maximum of 3.
300.3: If there is more than one Justice on the Supreme Court, then the justices will decide amongst themselves as to who will be the Chief Justice. If there is only one Justice, then that person receives the title by default.
300.4: A justice shall be any citizen, appointed by the President, who has been a citizen for at least one month.

Section 301: Term
301.1: A justice shall serve in his or her position for at least 3 months, but may be removed when a new President is elected, and appoints a new Justice. The President does not have to appoint a new Justice is he or she chooses not to.

Section 302: Powers and duties:
302.1: The Supreme Court shall have the following powers:
302.2: To review the legality of all Seanad actions as to how they line up with this constitution.
302.3: To hear and rule in all cases, both civil and criminal, within the Republic.

Article 4: Citizenship, and Citizen Rights
Section 400: Requirements
400.1: A person wanting citizenship will have to provide the following information:
400.2: Name, E-mail address, Macronationality, other Micronationalities, Interests
400.3: All applications shall be reviewed by the Immigration Committee, which shall consist of the Secretary of the Interior, another cabinet member, and a senator. This Committee must approve all applications for a person to gain citizenship.

Section 401: Rights and Rules
401.1: All citizens shall be guaranteed the following rights:
401.2: The right to free speech, unless it severely disrupts the peace on the forum
401.3: The right to choose and practice any religion, or have no religion at all
401.4: The right to have a fair and speedy trial in all instances
a. No citizen may be punished in any form for breaking any law, whether it be this constitution or a law passed by the Seanad, with out first having a fair and speedy trial.
401.5: Protection from discrimination based on race, sex, religion, or age
401.6: Citizens shall be forbidden from doing the following:
401.7: Partaking in Terrorism, which shall be defined as Hacking into the national forums or website to cause any sort of harm, whether it be deleting posts, editing posts, shutting down the site, deleting or banning members, or other attempts to disturb the public wellbeing
401.8: Partaking in Treason, which shall be defined as taking up arms against the Republic, either in rebellion or by joining and assisting a nation hostile to Emeraldia, or giving out national secrets, in the form of passwords, plans, or other state secrets out to an enemy nation or group.
401.9: Partaking in Identity Theft, which shall be defined as Using someone else’s username without permission, either to cause harm by changing information, or to harm another person's reputation by posting, or hacking into someone else’s account, either to cause harm by changing information, or to harm another person's reputation by posting.
401.10: Partaking in Papalism, which shall be defined as the creation of multiple forum accounts by and thereby pretending to be multiple persons.
401.11: Any citizen who breaks these rules, or restricts another citizen's rights will be subject to at least a one week ban upon conviction.

Section 402: National Census
402.1: New Citizens will be added to the National Citizen List upon their confirmation by the Citizenship Committee
402.2: The Department of the Interior will be required to take a census of the national population after a regularly scheduled election. All citizens on the Citizen List who did not either vote or post a notice of abstainment will be dropped from the list.
402.3: Any person dropped from the citizen list who still want’s to be a part of Emeraldia will have to reapply.
402.4: Property owned by any person who is dropped will be confiscated by the government. Material possessions will be sold at auction, with the money made going into the National Treasury, as will all money held in any accounts of the person dropped from the list.

Article 5: The Forum
Section 500: Administration
500.1: There shall be three levels of Forum Administration
500.2: Level 1 (Administrator)
a. Level 1 shall have full, unrestricted admin privileges
b. Level 2 is allowed to ban members, but only with permission of the courts
c. Level 1 is reserved for the President and Vice President only.
500.3: Level 2 (Security)
a. Level 2 shall have almost full admin privileges, with the exception of messing with individual member settings, general forum settings, deleting users, making announcements, or modifying user groups/ modifying who is in a group
b. Level 2 is allowed to ban members, but only with permission of the courts
c. Level 2 shall be reserved for the Director of the ESP
500.4: Level 3 (Moderators)
a. Level 3 shall have not be allowed to ban users, delete users, modify user groups, modify who is in user groups, view 'hidden' personal information, modify avatars, or make announcements. Moderators may only use their powers in boards that they are moderators of
b. Level 3 admins shall only be able to exercise their power within the boards that they are moderators of.
c. Level 3 shall be reserved for the cabinet members, representatives in the Seanad, and the Chief Justice of the Supreme Court.
500.5: The actions of administrator shall be reviewed monthly by the Administration Committee, which shall be made up of a cabinet member, a representative of the Seanad (not the Vice President), and the Chief Justice. If a member of the Committee is under review, they may not sit on the Committee, and another must take his or her place. If the Committee finds that an administrator has overstepped his or her powers, that person will be stripped of their powers and be banned from holding any offices after the next election.
500.6: Administrators are not allowed to modify or delete posts of other people without permissions, unless it is in their own boards. However, they can not delete posts just because they don’t agree with what is said. Posts can not be deleted unless they are totally of topic.

Section 501: Special Boards
501.1: Boards may be passworded, or hidden, by their own moderators.
501.2: People who are not given the password to a passworded forum are not allowed to post in these forums, in the event that they some how find out the password.
501.3: Only moderators of passworded forums may give out the password.

Section 502: The News Fader
502.1: All departments will have access to add things to the National News Fader, however they will be removed after 3 days, unless special permission is granted by a Level 1 or 2 administrator.
502.2: All things that are added may be removed by a Level 1 or 2 administrator, if they are deemed offensive by at least one administrator, at any time.
502.3: No department may remove the news of another department.

Article 6: Elections
Section 600: Dates
600.1: Elections will be held around the first day of the months of January, April, July, and October.
600.2: The exact date shall be set by the Seanad and the Electoral Commissioner.
` 600.3: The representatives of the Seanad will be elected by national vote every election
600.4 The President will be elected by national vote every election

Section 601: Administration of Elections
601.1: Elections shall be run by the Electoral Commissioner
601.2: the Electoral Commissioner shall be either appointed by the Chief Justice, or shall be the Chief Justice.
601.3 The Electoral Commissioner can not run in the election that he or she runs.

Section 602: Right to vote:
602.1: All citizens who have been a citizen for at least two weeks shall have the right to vote.
602.2: No citizen, unless he or she has been banned, may be prevented from voting.

Section 603: Nominations
603.1: All nominations for any office must be made at least 1 week prior to the elections.
603.2: A citizen may be nominated and run for multiple offices, but may only take one office. So, if they are elected to more than one position, they may only actually take one office, and must resign the others, and allow their opponents to take the other offices.
603.3: Only two nominations should be made for each office.

Article 7: Culture
Section 700: Definition
700.1: The Culture of Emeraldia shall be based on the Irish/Celtic culture of Ireland.

Section 701: Official Languages
701.1: There shall be 2 official languages in Emeraldia:
a. English
b. Gaelic (Irish)
701.2: All signs on the forum or any official site may be written in either language, but if written in Gaelic must have an English translation.

Section 702: Official Religion
702.1: The official religion of Emeraldia shall be Christianity.

Article 8: The Provinces
Section 800: The Provinces of Emeraldia
800.1 The Provinces of Emeraldia are
800.2: Province of Galway
800.3: Province of Limerick
800.4: Province of Kerry
800.5: Province of Cork
800.6: Province of Ulster

Section 801: The Federal Zones
801.1 The Federal Zones are:
801.2: Federal District of New Dublin, Capital of Emeraldia

Section 802: Governance
802.1 Until the Provinces elect a government of their own, they shall be run by the Department of the Interior. Once they decide to create their own governments, their new governments must have a legislature and governor.
Section 4: Until the Federal District of New Dublin elects a mayor and City council, it shall be run by the Department of the Interior

Article 9: Changes
Section 900: Amendments
900.1: For a proposed amendment to pass, it must:
900.2: Be submitted to the legislature, and be approved by a 4/5 majority
900.3: Be Approved By the President
900.4: Be voted on by the citizens and be approved by a 2/3 majority

Section 901: Constitutional Convention
901.1: This constitution can also be changed during a constitutional convention
901.2: To hold a convention, the following must be done:
a. A citizen must first motion to have a convention in a public forum
b. the motion must be seconded.
c. Once the motion is seconded, the Chief Justice will open up nominations to elect a Convention Speaker for 24 hours.
d. Once nominations are over, the Chief Justice will open up a poll for an election.
e. Once the speaker is elected, he will run the convention, opening and closing polls, etc.
f. The convention will end when a motion is made to adopt the changes (or a new constitution), and the motion is seconded. Once the motion is seconded, the Speaker will make a poll to adopt the changes. It the motion is passed, the convention ends. If, however, the motion fails, then the convention will either continue or can be closed with nothing changed.

Section 902: All amendments shall go into effect 3 days after final approval. Amendments may not be retroactive.

Article 10: Supremacy
Section 1000: Once this constitution is approved, it shall be the supreme law of the land, unless it is changed by amendment, or the people of the republic adopt a new constitution in a constitutional convention

This was the constitution of Emeraldia that was approved by a constitutional convention that was held in March 2007. After the first "attack" on Emeraldia, the people wanted to strengthen the government so that it could better handle a crisis. It also solidified Emeraldia's forum policies, which had before been vague and was part of the cause for the first "attack"

Declaration of the Irish Republic of Emeraldia

On this 6th day of November, in the year 2006, the Irish Republic of Emeraldia has been declared an independent nation.

Emeraldian Culture:
Emeraldian culture shall be defined as this: The Celtic culture of Ireland, and the languages on English and Gaelic. All citizens, upon receiving citizenship, shall be required to take an Irish name.

Governance:
As soon as the IRE has at least 3 citizens, a constitutional convention shall be held to create a democratic government. However, until such time that a constitutional convention can take place, the Irish Republic of Emeraldia shall be led by Interim President Aaron O’Wray* who shall act as head of state, and commander in chief of the IRE. The Interim President may make any sort of office or department that he deems necessary for the IRE until the creation of a democratic government.

Aaron O’Wray* Interim President of the Irish Republic of Emeraldia


*Note: Aaron O’Wray is the Irish name of citizen Zachary Anderson

This is the Declaration of Emerldia, the document that officially founded the Irish Republic of Emeraldia. The reason that this left the governance so open is founder and President Aaron O'Wray wanted imput from the people before establishing a 'permanent' constitution.
21 days later, on November 27, 2006, the nation's first constitutional convention approved the first constitution of Emeraldia.

This small document was used by the Interim President to establish what would become through that above mentioned convention all of the members of the Emeraldian Cabinet, save the Emeraldian Security Protectorate, which was established later. The Interim government officially handed over control to the elected government just after New Years Day 2007.

There is another interesting feature on the Declaration. In accordance with the law he himself established, the founder took on an Irish name, Aaron O'Wray, with which he officially signed this document. However, to avoid any possible confusion or issues later, the founder puts a sub-note stating his real name, Zach Anderson. This was the only document in Emeraldia that has this name mentioned.
